Inboxbid Placements (inboxbid.lol)

This addendum applies to inboxbid.lol and prevails over the rest of these Terms of Service wherever the two differ. inboxbid.lol is operated and billed by HeyNews LLC; charges appear on card statements as "HEYNEWS* INBOXBID".

What a Bid Buys

A bid is a one-time payment that takes or defends a rank on the board. It is not a subscription and it does not renew, so the subscription and renewal terms of these Terms of Service do not apply to it. Payment is taken by Stripe through Stripe Checkout. Ranking is by settled bid amount, and your rank may fall at any time when another newsletter pays more. We do not guarantee any rank, any level of traffic, or any commercial outcome from a placement.

Your Listing Is Public and Permanent

The name, description, website address and logo you supply are published publicly on the board and are readable by anyone, including search engines and AI crawlers. A listing is permanent: it can be outranked, but it is never removed, and there is no self-serve delete. Do not submit anything to a listing that you are not willing to publish permanently. Nothing in the user content terms of these Terms of Service gives you a right to have a settled listing taken down.

Your Warranties for a Listing

By paying for a placement you warrant that you own or are authorised to represent the newsletter you list, that the content you supply is accurate and does not infringe any third-party right, and that you hold the rights needed for us to display the logo you supply.

Eligibility Review

We review listings for eligibility and may hide a listing from public view, or decline to display content that breaches the acceptable use or user content terms of these Terms of Service. A hidden listing remains a settled payment record; hiding it is not a refund and is not a removal.

Refunds and Disputes

Because a placement is delivered as soon as the payment settles, bids are non-refundable except where a refund is required by law or we grant one at our discretion. The refund terms of these Terms of Service do not apply to inboxbid.lol. If you believe a charge is wrong, contact us at legal@heynews.co before opening a dispute with your card issuer so that we can resolve it directly.

Survival

A listing outlives the agreement that bought it, so this Inboxbid Placements addendum survives termination of these Terms of Service in full.

Newsletter Hosting

This addendum applies when HeyNews LLC hosts a newsletter publication for you and sends its email ("Newsletter Hosting"). It prevails over the rest of these Terms of Service wherever the two differ, except that the Data Processing Agreement prevails on the processing of personal data and on a refund it requires after an unresolved sub-processor objection. HeyNews newsletter hosting is a fully managed cloud service for Ghost.

Commercial use and tracking

The "Commercial use of the Services" section of these Terms of Service applies to Newsletter Hosting: you may run your publication as a business and measure opens and clicks, as long as you follow this addendum, the Acceptable Use Policy and the law.

You are the sender and the controller

You are the sender of every email your publication sends, and the controller of your subscribers' personal data. We send on your instructions and process subscriber data as your processor under the Data Processing Agreement at heynews.co/dpa, which forms part of these Terms for Newsletter Hosting. You are responsible for the content of your emails, for your list, and for complying with anti-spam and privacy law, including CAN-SPAM, CASL and the GDPR where they apply. Each email must identify you, include a valid postal address and include a working unsubscribe link. You must publish your own privacy notice to your subscribers.

Your warranties

You warrant that every address you send to has given you consent that is valid under the law that applies to it, and that you can show us a record of that consent on request. You will not import or send to purchased, rented, scraped, shared or appended lists. You will honor unsubscribe requests promptly, and in any case within the time the law requires.

Acceptable Use Policy

You must follow the Acceptable Use Policy at heynews.co/acceptable-use-policy. It applies in addition to the restrictions in the rest of these Terms of Service.

Suspension

We may suspend sending, or your whole publication, immediately and without prior notice if we reasonably believe that you have breached this addendum or the Acceptable Use Policy, or if your bounce or complaint rates put our sending infrastructure or other customers at risk, or if our email or hosting provider requires it. We will tell you why and, where the problem can be fixed, how to restore service.

Indemnity

You will defend, indemnify and hold harmless HeyNews LLC against any claim, fine, penalty, loss or cost, including reasonable legal fees, that arises from the email your publication sends, your list, your content, or your breach of this addendum, the Acceptable Use Policy or the law.

Ending Newsletter Hosting

You may end Newsletter Hosting at any time by writing to support@heynews.co. When it ends, for any reason, you can ask us for an export of your subscriber list and content within 30 days. We then delete your publication and its subscriber data within a further 30 days, except where the law requires us to keep a record.

Survival

The warranties, indemnity and data deletion terms of this Newsletter Hosting addendum survive termination of these Terms of Service.
